Recommendations:
THAT WHEREAS Section 72 of the Community Charter
empowers a Council to impose remedial action requirements;
AND WHEREAS the City Council of the City of Port Moody
believes that the tree as identified in photographs attached to
and forming part of this Order as Schedule "A" (the "tree") on
lands with a civic address of 905 Clarke Road, and a legal
description of LT 3, BLK A, PLAN 7054, DL 377, NEW WEST
DISTRICT EXCEPT PLAN 16126, 32466 (hereinafter referred to
as the "lands") is unsafe because it has been damaged by fire
and excavating equipment.
AND WHEREAS the owner of the lands upon which the Tree is
located has neglected, refused or otherwise failed to remove the
tree;
AND WHEREAS Section 73 of the Community Charter empowers
a Council to order the removal of thing which is unsafe;
NOW THEREFORE BE IT RESOLVED THAT:
The City of Port Moody: Pursuant to Section 73 of the Community Charter and upon
Council having found that it considers the Tree to be in an
unsafe condition;
A remedial action hereby orders, authorizes and directs the
removal of the Tree by the Owner.
The owner of the lands shall be given thirty (30) days notice of
the remedial action requirement herein. Upon expiration of the
thirty (30) days notice period, if the owner has still neglected,
refused or otherwise failed to remove the Tree as required, the
City of Port Moody hereby authorizes agents, contractors, and
employees of the City of Port Moody to enter the lands and
remove the Tree, with this work to be carried out at a time and in
a manner at the administrative convenience of the City of Port
Moody.
In the event that the owner does not remove the Tree, the
charges, fees and costs incurred by the City of Port Moody to
remove the Tree, shall be payable forthwith on demand and in
the event that any such amount remains unpaid by December 31
of the year such charges, fees and costs are incurred, such
amount shall be a charge or lien on the lands, and deemed to be
taxes in arrears and shall be collected in the same manner and
with the like remedies as ordinary taxes on land and
improvements under the Community Charter.
